In 1997, LEAF provided a submission to the Standing Senate Committee on Legal and Constitutional Affairs concerning Bill S-5: An Act to Amend the Canadian Human Rights Act.
LEAF argued that some of the amendments might serve to undermine the purposes of the Canadian Human Rights Act. In particular, LEAF expressed concern that the amendments would have serious and potentially very negative consequences for the equality rights of all Canadians, especially women and women with disabilities.
LEAF expressed concern about the importing of the duty to accommodate into the Canadian Human Rights Act. LEAF pointed out problems with the duty to accommodate and concerns with expanding the duty to accommodate to all grounds of discrimination. LEAF argued that, if the duty to accommodate was incorporated into the Canadian Human Rights Act, the defense of undue hardship needed to be stringent.
