Facts
Ivy Tyson worked at Goodhost Foods, which had a policy requiring employees to retire at age 65 with no pension. Provisions in the Ontario Human Rights Code allowed mandatory retirement at the age of 65.
Arguments
Ms. Tyson, with LEAF’s support, argued that the provisions of the Ontario Human Rights Code violated her equality rights under s. 15 of the Charter.
Outcome
Goodhost Foods settled the case. Ms. Tyson’s employment continued, and the company established a pension plan.
