Over 50 organizations, human rights advocates, and legal scholars are urging all federal political party leaders to commit to holding a public consultation on the use of the notwithstanding clause within six months of forming a new government.
This joint letter expresses concern over the increasing use of the clause by provincial governments to override fundamental Charter rights—such as freedom of expression, religion, and equality. It warns that this trend poses a serious threat to Canadian democracy and calls for federal leadership on the issue.
The proposed consultation would be inclusive of equity-deserving communities and focused on exploring potential solutions—ranging from adding safeguards to repealing the clause altogether.
